Public institution

A public institution is a legal entity governed by public law and mandated by law to manage one or more specific public services in order to meet the special needs of the population, under the supervisory control of: 

  • the State;
  • the municipalities from which it is detached by virtue of decentralisation by services. 

 

A public institution is created by a law which: 

  • determines its organisation and purpose;
  • may, in particular, specify its missions and functioning. 

 

The public institution has legal personality and financial and/or administrative autonomy. It may have the power to make regulations within the limits of its speciality. These regulations may be subject to: 

  • to the approval of the supervisory authority;
  • to the control of judges, who may annul or suspend them in the event of illegality.
