General Terms and Conditions of Use of the Public Sector Data Catalogue

These general terms and conditions of use define the rules for using the Public Sector Data Catalogue (hereinafter referred to as 'the Data Catalogue'), an initiative of the Ministry for Digitalisation (4, rue de la Congrégation, L-1352 Luxembourg).

The Data Catalogue is one of the key tools for the digital transformation of the State and for the provision of centralised legal and technical assistance and expertise in the areas of digital transformation, data management and artificial intelligence to State administrations, by the Ministry and its competent administrations, namely the Government Commission for Data Sovereignty and the State Information Technology Centre, under the coordination of the Ministry for Digitalisation. It contains metadata about public sector datasets, provides transparency on the existence of public sector data and enables centralised searching of public sector datasets. All public entities are invited to make their data resources available through the Data Catalogue, thereby contributing to the valorisation of public sector data.

By easily and conveniently finding available public sector data in the catalogue, the data can be valorised, for example through a request for access to and re-use of data by a natural or legal person for the purposes of applying the provisions of Regulation (EU) 2022/868 on European data governance and amending Regulation (EU) 2018/1724.

Any person using the data, information, documents and various services (collectively referred to as the 'services') offered by this platform is deemed to be aware of, and to have accepted, all the provisions of these general terms and conditions of use. Use of the platform shall be subject to the latest version of the General Terms and Conditions of Use, available on the platform at the time of such use. Failure to comply with any of the Terms and Conditions of Use will automatically terminate your authorisation to use the platform.

Conditions for access to the platform

The Public Sector Data Catalogue is a government platform used to search for public sector data available for valorisation. 

Access to the platform is free to the general public and the platform is available via the internet. The user declares that they are aware of the risks involved and that they accept them. They must guard against the effects of computer hacking by implementing suitable and secure computer settings.

The Ministry for Digitalisation accepts no liability for any loss or damage that the user may suffer directly or indirectly in connection with browsing this platform and using its services, or the websites to which it refers.

The services offered by the platform

The services offered by the platform are structured around two main axes:

Data holders: any public entity that holds data that can be made accessible to public data re-users through the Data Catalogue. In order to ensure the reliability of the metadata published on the platform, data providers are official representatives of public entities.

Data re-users: any natural or legal person who submits a request for access to and re-use of data for the purposes of applying the provisions of Regulation (EU) 2022/868 on European data governance and amending Regulation (EU) 2018/1724.

The metadata contained in the Data Catalogue

It is important to distinguish between metadata and data. The information available in the Data Catalogue constitutes metadata, i.e. information about the data (title, description, owner, etc.). The (meta)data model used by the Data Catalogue is DCAT-AP-LU (Data Catalogue Vocabulary - Application Profile - Luxembourg). The metadata then refers to the data itself via a 'dataset identifier', usually in the form of a link to create a data access request. The metadata and data together are often referred to as a dataset. The metadata is stored in the Data Catalogue, while the data itself remains with the data holder.

Limitations of liability

The Ministry for Digitalisation will use its best endeavours to ensure maximum availability of the Data Catalogue and the security of the information systems. However, it cannot be held liable in the event of temporary or total unavailability of the Data Catalogue, or in the event of an attack on the information systems. The unavailability or malfunctioning of the services does not entitle the user to any compensation.

The Ministry for Digitalisation reserves the right to develop, modify or suspend the Data Catalogue without prior notice for maintenance, updating or any other reason deemed necessary.

The Ministry for Digitalisation explicitly excludes liability for any direct and indirect consequences of:

  • incompatibility between the Data Catalogue and the equipment, applications, procedures or infrastructure of the user or third parties;
  • a security breach originating from the user or a third party and, more generally, any security breach not directly attributable to the Data Catalogue;
  • the consequences of errors and/or fraud committed by the user or a third party;
  • any unavailability or malfunction of electronic communications systems or networks.

Data holders are solely responsible for the data, metadata or content they publish in the Data Catalogue, and shall ensure that such publication complies with the legislation in force. The Ministry for Digitalisation expressly disclaims any liability in this regard.

User commitments and responsibilities

Data holders and re-users are invited to use the Data Catalogue, as well as the data to which they have gained access, with due respect for everyone and in compliance with the laws in force. This includes, but is not limited to, laws concerning the protection of privacy and personal data, laws concerning intellectual property, and the criminal code.

Cookie management

This site uses client cookies, small text files used to analyse the user's browsing activities (frequency of visits, duration of visits, pages viewed, etc.).

Cookies are stored by the site in a directory provided for this purpose on the user's computer. A cookie contains the name of the server that created it, an identifier in the form of a unique number and an expiry date. The unique identifier allows the site to recognise the user's computer each time they visit the site. Session cookies are deleted from the user's computer when the session is closed. However, persistent cookies remain on the user's computer for one month after the end of the session.

Users can decide whether or not this site's web server is allowed to store cookies on their computer. They may change their browser settings at any time to prevent cookies from being accepted and stored. Moreover, the user can delete all previously stored cookies at any time using their browser.

The use of certain site functions may be limited or disabled if the user refuses the site's cookies. It is therefore recommended that the user set their browser to accept cookies from the site.

Intellectual property

The Data Catalogue, all its elements (including the layout) and the information and services are protected by the relevant intellectual property and copyright legislation.

Unless otherwise specified, the Ministry for Digitalisation does not grant any licence or authorisation relating to the intellectual property rights it holds over this website, its elements or the services. Furthermore, no reproduction of the information or services, either in whole or in part, and in any form whatsoever or by any means whatsoever, is permitted without the prior written authorisation of the Ministry for Digitalisation.

Applicable law and competent jurisdictions

Any dispute relating to the use of the Data Catalogue and its services shall be subject to Luxembourg law and shall fall within the exclusive jurisdiction of the courts of the Grand Duchy of Luxembourg.
