To simplify your journey as a data re-user, the Government Commission for Data Sovereignty, acting as the Luxembourg Data Authority, makes available a centralised interface and single procedure that allows you to:

  • submit one online application for re-use of data to access the public sector data you need for your project,
  • receive the data requested in your application in an anonymised, pseudonymised and/or aggregated format, within a Secure Processing Environment managed by the Government Commission for Data Sovereignty.

Once your application for re-use of data is approved, you gain access to the data to re-use them without having to worry about:

  • anonymisation, pseudonymisation, and data aggregation,
  • setting up IT systems and infrastructure for the re-use of data,
  • clarifying roles and responsibilities under the GDPR,

Protection of personal data

The Government Commission for Data Sovereignty (located at 5, rue Plaetis L-2338 Luxembourg, +352 247-67700 / info@cgsd.etat.lu) acts as the controller for the preparation and provision of personal data held by public sector bodies for the purpose of enabling authorised individuals and organisations (data re-users) to access and re-use data in compliance with data re-use legislation. In accordance with applicable legislation, the processing operations carried out by the Government Commission for Data Sovereignty are lawful in accordance with Articles 6, paragraph 1), letters c), e) and f), as well as 9, paragraph 2), letters e) to j), of Regulation (EU) 2016/679 (GDPR).

Data access and re-use may, depending on the authorisation, take place from third countries (outside the European Economic Area). In such cases, international data transfers are governed by EU Standard Contractual Clauses under Article 46 of Regulation (EU) 2016/679, signed by the data re-users.

Data within the Government Commission for Data Sovereignty's Secure Processing Environment is deleted within six months after the authorisation expires, without prejudice to compatible further processing for verification, analysis, statistics, or evidence purposes. In such cases, data may be retained for up to 30 years from the date of the Government Commission for Data Sovereignty's decision or the end of authorised data re-use duration.

Individuals whose data is processed for these purposes have, as defined by law, the rights set out in Articles 12–22 of the GDPR, in particular the right to object to processing. The Ministry coordinates all national inventory efforts and manages the Public Sector Data Catalogue (CDSP). It is your main point of contact for:

  • strategic and policy issues,
  • publishing your metadata in the Public Sector Data Catalogue,

  • helping a re-user find the holder of the data they are looking for,
  • the national metadata standard, DCAT-AP-LU.
